Do I Need a Mexican Will If I Own a Condo in Mexico?

If you are Canadian and own a condo or other property in Mexico, you may wonder whether your Canadian will is enough.

In many cases, having a Mexican will can make the process of dealing with your Mexican property much simpler.

A Mexican will can specifically address assets located in Mexico and help your family avoid unnecessary delays, costs, and complications when your estate is administered.

If your property is held through a fideicomiso (Mexican bank trust), your situation may be different. The trust documents and designated beneficiaries can play an important role in determining what happens to the property after your death.

Your Canadian will does not automatically make Mexican succession procedures disappear.

If you own property in Mexico, it is worth having your Canadian estate plan reviewed together with your Mexican property documents to ensure the two work properly together.
